Clancy’s Defense Sees a Path to Freedom as Prosecutors Weigh a Retrial
A mistrial has transformed Lindsay Clancy’s murder case from a question of guilt into a battle over whether the state gets another chance to prosecute her.

Clancy’s defense attorney, Kevin Reddington, plans to file a motion seeking dismissal on double-jeopardy grounds. He argues that the mistrial was not supported by “manifest necessity,” particularly after jurors reported that one holdout acknowledged reasonable doubt but allegedly refused to apply the judge’s instructions. Reddington says he will present the motion at a Sept. 29 status hearing.

The defense frames the dispute as a procedural failure. Reddington said the holdout had a right to resist a verdict, but argued that refusing to follow the law was different: “That’s when I was upset, because that’s why I used the expressions and the terms I did. It just wasn’t right.” The jury reportedly split 11 to 1 after more than seven days of deliberation, and the judge rejected requests to remove the juror or question the panel further.

The prosecution’s position remains less developed publicly. Plymouth County District Attorney Tim Cruz has not said whether he will seek a retrial, but a new prosecution is ordinarily possible after a mistrial. Legal analyst Caroline Polisi called Reddington’s proposed motion “huge news” but also a “long-shot,” noting that double jeopardy typically does not prevent the state from trying a case again after a deadlocked jury.

The underlying clash is equally stark. Prosecutors say Clancy planned the killings and understood right from wrong; the defense attributes the deaths to postpartum psychosis and excessive medication. Reddington wants no jail sentence and has even urged President Trump to help resolve the state case, though Trump can pardon only federal offenses. For now, the mistrial has delivered neither acquittal nor conviction—only another legal contest over whether the case can continue.
