Off-Duty ICE Agent Faces Felony Charges After Being Shot During Alleged Fresno Assault
An early-morning confrontation on a Fresno property has produced a rare reversal of roles: an off-duty federal immigration officer was shot after allegedly attacking an elderly man and his daughter, then arrested on felony charges.
The basic facts are presented differently but point to the same unsettled question. A conservative account frames the incident bluntly as an off-duty ICE agent being shot “after assaulting elderly man and daughter on Fresno lawn,” according to police. A liberal account places greater emphasis on the alleged conduct preceding the shooting, reporting that the agent was “intoxicated and agitated” when he confronted the residents.
According to Fresno police, a woman found David Gonzalez sleeping on the family’s front lawn at about 3 a.m. When she and her father tried to remove him, police said Gonzalez forced the 72-year-old man to the ground and then attacked his daughter when she intervened. The father, fearing for their safety, shot Gonzalez once. The daughter’s boyfriend, an off-duty police officer, later arrived and handcuffed him.
Gonzalez was treated for a gunshot wound and booked on charges including battery likely to cause great bodily injury, felony vandalism and battery. The father and daughter were not arrested, though both reportedly suffered injuries. Police said Gonzalez was off duty, alone and that his reason for being in the area remained unknown.
The immediate dispute is therefore less about competing accounts of the shooting than about what preceded it: police characterize the shooting as a response to an alleged assault, while the defense of the ICE agent’s conduct has not been publicly detailed. The case also lands amid broader criticism of ICE’s aggressive enforcement and hiring practices. The available report notes previous allegations involving agency personnel, but those cases do not establish wrongdoing by Gonzalez or prove a pattern in this incident.
