Authors Fear Their Anthropic Payouts Are Being Claimed Away
Anthropic’s $1.5 billion class-action settlement, approved in July, set the stage for payments over nearly 500,000 pirated books used in AI training. The agreement calls for $3,000 per work: a 50-50 split for titles still in print with traditional publishers, but a full payment to writers whose books were self-published or whose rights had reverted.

As the settlement administrator began sorting ownership claims, authors started receiving notices that publishers—or, in some cases, literary agencies—were seeking part of their awards. The flashpoint is often the date rights reverted: authors seeking 100% must show the reversion happened before Aug. 10, 2022, the settlement’s designated download date.

Writers have framed some claims as far more than paperwork. Mystery author April Henry said HarperCollins had claimed a book whose rights reverted “at least 17 years ago,” while author Courtney Milan blasted reports of agents seeking percentages, arguing they should not do so. Victoria Strauss of Writers Beware said the complaints clustered around two patterns: publishers claiming reverted titles and seeking the entire payment where they would be entitled to half. She cautioned against assuming bad intent, but said the repeated nature of the reports suggested a potentially systemic problem rather than routine glitches.

The Authors Guild offers a less accusatory reading. Its chief executive, Mary Rasenberger, said competing claims were foreseeable because publishers do not always maintain clean rights-reversion records. “I don’t see this as a grab by the publishers,” she said, adding that she did not think they were “specifically trying to screw any author over.”

That does not resolve the immediate stakes. Each disputed title now forces a records test—and for authors, an uncomfortable question of whether a long-closed publishing relationship is still taking a share of money they believe is theirs.
