Nunes Marques Steps Aside as Critics Question Moraes Case
Justice Kassio Nunes Marques has withdrawn from the Supreme Federal Court’s consideration of whether to open an investigation involving Justice Alexandre de Moraes, a move also reported by a right-leaning outlet. His explanation, however, centers on institutional caution rather than the merits of the allegations.

Nunes Marques, who serves as president of the Superior Electoral Court (TSE), said the proceeding could affect Brazil’s political and electoral environment less than three weeks before the first round of the 2026 election. “I have no doubt that this trial may eventually also affect the political-electoral scenario,” he said. “As president of the TSE, I do not feel comfortable taking part in this trial, and I declare myself recused.”

The case comes amid reports of messages recovered from former banker Daniel Vorcaro’s phone that refer to Nunes Marques, his son and matters before the courts. The justice said he had never overseen a case connected to Banco Master, denied that his son worked for the bank or received money from Vorcaro, and said there were no direct messages between himself and the former banker.

His decision has nevertheless prompted criticism from commentators who focus on the comparison with Moraes. Rodrigo Constantino argued that Nunes Marques had found himself unable to vote in the Moraes/Master matter while “Alexandre de Moraes did not,” calling that contrast the essence of the dispute. In another post, Constantino alleged that Moraes sought to prevent Justice André Mendonça from voting while remaining eligible to vote himself, describing the comparison as a “false equivalence.”

Paulo Figueiredo likewise criticized what he portrayed as a lack of accountability among Moraes’ defenders, while amplifying a call for Moraes to resign from the court. Those posts offer political commentary rather than judicial findings. What is undisputed in the reporting is narrower: Nunes Marques has left the courtroom and will not take part in the decision on a possible investigation of Moraes.
