Gilmar Mendes Warns the TSE’s Biggest Threat May Be Internal
Justice Gilmar Mendes has cast Brazil’s 2026 electoral challenge as a test of whether the courts can withstand pressures from outside and within. He warned that artificial intelligence can generate videos, audio and campaign material able to “mislead voters and unbalance electoral contests,” while also citing concerns about possible foreign interference.
Supportive accounts emphasize the practical basis for that warning. One report cited a test in which 13 of 15 AI-generated false political advertisements reportedly passed Meta’s moderation systems, including material falsely depicting the TSE president changing the first-round election date. Mendes also defended electronic voting machines as auditable and said the Electoral Justice system’s work must remain tied to the Constitution and the law.
Another account similarly foregrounded his call for an “upright, impartial and non-partisan” electoral authority, presenting the statement as a response to deceptive technology, external pressure and efforts that could distort voters’ will. Mendes argued that the more serious danger is internal: “the politicization of Electoral Justice.” He said parties and the Electoral Public Prosecutor’s Office should challenge justices when grounds for recusal exist.
Critical coverage, however, treated the language as less abstract. One report said the remarks were an indirect message to TSE president Kassio Nunes Marques and vice-president André Mendonça, while noting that this was an interpretation attributed to interlocutors rather than a direct identification by Mendes. It also questioned whether Mendes applies his own standard consistently.
The dispute was echoed on X. Commentator Rodrigo Constantino wrote that Mendes was praising “Moraes’s TSE” while raising suspicions about the current leadership involving Kassio and Mendonça. Paulo Figueiredo offered a still harsher reading, describing the move as “targeting the TSE and preparing the coup.” The shared principle is impartiality; the disagreement is over the intended target and credibility of the warning.
