Gilmar Mendes clears Bolsa Família increase as election challenge persists
Justice Gilmar Mendes of Brazil’s Supreme Federal Court has ruled that the 15.04% adjustment to Bolsa Família is constitutional, clearing the way for the programme’s minimum monthly benefit to rise from R$600 to R$691. Payments at the new level are due to begin with the October payroll, from October 19.
Mendes’s reasoning treats the measure as an inflation-linked update to an existing permanent programme rather than a new electoral benefit. He said it followed the court’s own requirements for the progressive implementation of a basic citizens’ income and anti-poverty policy. In his view, the adjustment applies an objective monetary-correction rule, without changing eligibility rules or expanding the number of recipients, and therefore does not constitute prohibited conduct in an election year.
That interpretation is contested by opposition figures. Federal deputy Zé Trovão, of the PL party, petitioned the Superior Electoral Court seeking to challenge President Luiz Inácio Lula da Silva’s candidacy registration, arguing that the announcement breached electoral rules. Justice André Mendonça dismissed the filing without addressing its merits, citing the petitioner’s lack of standing in that forum. Presidential candidate Renan Santos has lodged a similar request, arguing that election law bars actions that may affect equal opportunity among candidates.
The benefits case is distinct from a wider political debate over the Supreme Court, but it arrives in the same charged climate. A Gazeta do Povo survey found 106 Senate candidates supported impeachment proceedings against Supreme Court justices, while 18 opposed them; the report linked the issue to growing institutional tensions and said it could become an election theme.
The two debates involve different legal questions: Mendes’s ruling focuses on continuity and purchasing power in a social programme, whereas critics of the timing focus on electoral fairness. Both, however, place judicial authority at the centre of an already contested campaign.
