TSE Campaign Ban Keeps Dallagnol on Ballot but Off the Trail

Brazil’s electoral court has upheld restrictions preventing Deltan Dallagnol from campaigning for the Senate in Paraná. His supporters argue the measure is unprecedented while the court’s majority sees it as necessary to preserve a prior eligibility ruling.

Brazil’s Superior Electoral Court, or TSE, formed a majority to maintain an injunction barring Deltan Dallagnol from carrying out Senate campaign activities in Paraná. The order does not cancel his candidacy or remove his name from the ballot, but it blocks campaign events, radio and television advertising, and the use of public campaign and party funds.

Dallagnol’s defence argues that distinction is precisely the problem. Lawyer Leandro Rosa said the candidate’s registration had been accepted by the Paraná Regional Electoral Court and argued that electoral law allows candidates with cases still under review to conduct campaign activities. He called the broader prohibition on campaign appearances “absurd” and “unprecedented,” saying he expected the court not to preserve the limitation.

A social-media message shared by commentator Rodrigo Constantino similarly urged supporters to distinguish between the campaign suspension and the candidacy itself: “Deltan remains a candidate,” the quoted post said, while acknowledging that he could not campaign.

The court majority’s rationale takes the opposite view. Justice Floriano de Azevedo Marques said the Paraná court had departed from the TSE’s earlier decision concerning Dallagnol, whose federal deputy mandate was revoked after the court concluded that his early resignation from the Federal Prosecutor’s Office sought to avoid potential disciplinary consequences. In this reading, the subsequent closing of internal proceedings does not undo the conduct that underpinned the previous ruling.

Supporters of the injunction also point to electoral consequences: allowing a candidacy later deemed unviable to proceed could irreversibly affect voters’ choices, particularly in a Senate race with two seats at stake. Dallagnol’s side, however, maintains that those concerns should not override the rights attached to a registration that remains in force.
