Mendonça Seeks Moraes Probe as STF Justices Trade Claims

Justice André Mendonça wants Brazil’s Supreme Court leadership to investigate Alexandre de Moraes over intelligence reports used against him, while Moraes argues Mendonça’s own actions should be scrutinized. The competing requests now rest with STF President Edson Fachin.

Mendonça Seeks Moraes Probe as STF Justices Trade Claims
Justice André Mendonça has asked Supreme Federal Court (STF) President Edson Fachin to investigate how Federal Police intelligence reports were produced and reached Justice Alexandre de Moraes’s office. Mendonça says the material was used to make unfounded accusations about his conduct in the INSS and Banco Master-related inquiries, and has requested access to the full Fake News Inquiry.

Mendonça’s position is that the reports lack basic markers of authenticity, including identified authorship, and carry warnings that they have no evidentiary value. He describes them as an “intelligence dossier prepared for an improper purpose” and argues that Moraes distorted their contents by attributing alleged misconduct to him rather than to police teams mentioned in the documents. He also questions how Moraes knew the reports existed before formally requesting them from the Federal Police.

Moraes presents the dispute differently. He has sought dismissal of Mendonça’s request and backed a criminal investigation into his colleague, arguing that Mendonça acted as an investigator by ordering targeted police measures. Moraes also alleges that Mendonça interfered with inquiries and improperly pressed collaborators to implicate public officials.

The disagreement extends to the scope of the Fake News Inquiry. Mendonça argues that its rapporteur could not expand its original mandate on his own to seek material about individual justices or find “strong indications” against a colleague without submitting the matter to the full court. Supporters of his view have amplified criticism of the Federal Police’s role online; commentator Rodrigo Constantino called for exposing what he termed the police force’s “Alexandrine wing.”

For now, neither set of allegations has been upheld. The competing requests, including Mendonça’s call to invalidate the reports and archive the case against him, are for Fachin to assess.
