Zanin Halts Push to Force Banco Master Inquiry, for Now
Justice Cristiano Zanin of Brazil’s Supreme Federal Court has denied an emergency request by Senator Alessandro Vieira to compel Senate President Davi Alcolumbre to move forward with a parliamentary commission of inquiry, or CPI, into Banco Master.
Vieira says his request, filed on March 9, carried 41 signatures—well above the 27 required in the Senate—and had remained unread, unnumbered and unpublished for nearly six months. The proposed 120-day inquiry would examine possible personal, financial or other links between Banco Master controller Daniel Vorcaro and Supreme Court justices Alexandre de Moraes and Dias Toffoli, as well as whether such relationships affected the justices’ work.
The account published by Brazil Left focuses on Zanin’s procedural rationale. The justice found that the case file did not yet demonstrate an unlawful omission by Alcolumbre, particularly because Vieira himself had acknowledged an earlier Banco Master-related CPI request. Zanin said the newer proposal could be a development of facts already covered, rather than an entirely separate inquiry, and ordered Alcolumbre to provide information before reconsidering the case. He nevertheless noted that CPI creation is a political and legal prerogative of parliamentary minorities.
Brazil Right emphasizes the contrast between the surplus of signatures and the absence of an installed commission after months of waiting. It likewise reports that Zanin refused the urgent order because there were not yet sufficient grounds for Supreme Court intervention or proof of an unconstitutional omission. “The discussion has not ended,” Vieira said after calling the decision a “disappointment,” pledging to submit additional material and seek a review.
The two accounts therefore converge on the immediate outcome: no court order will force the Senate to act now. Their difference is one of emphasis—whether the central issue is the need to clarify overlapping requests or the Senate’s failure to advance a request that its sponsor says has already met the constitutional threshold.
