Fachin seeks PGR review before ruling on Master and INSS requests
Supreme Federal Court President Edson Fachin has asked Brazil’s Prosecutor General’s Office, or PGR, to assess outstanding requests in the Banco Master and INSS investigations within five days. The cases will then return to Fachin for a decision.
The accounts agree on the immediate effect: the order does not decide whether any detention will be reviewed, whether the cases’ transfer to the court presidency will be revisited, or how the investigations will proceed. A report from the left describes the matters as having been under Fachin’s authority since September 12 and “paralyzed” after they were removed from Justice André Mendonça’s chambers amid an exchange of accusations involving Justice Alexandre de Moraes.
The right-leaning account places greater emphasis on the limited scope of Fachin’s instruction. It says the PGR was told to assess the “relevance, necessity, adequacy and possible repercussions” of the requested measures for ongoing investigations, before the court president rules.
The pending applications involve several distinct interests. Henrique Vorcaro and Felipe Vorcaro have sought steps that would allow challenges to their detentions to be heard; Fabiano Zettel and Daniel Lopes Monteiro have requested review or revocation of their preventive detention. The Brazilian Bar Association has asked for protection of lawyer-client communications that may appear in seized investigative material.
Mendonça has also submitted a response concerning a report used by Moraes in connection with allegations against him. While the two accounts differ in emphasis—one stresses the procedural standstill, the other the PGR’s screening role—both conclude that no request has yet been granted or denied. Fachin’s next ruling is expected only after the prosecutorial opinion is filed.
