Court Orders Marina Helena Video Removed Over Erika Hilton Portrayal
The Regional Electoral Court of São Paulo ordered social-media platforms to remove “The Magical World of Erika Hilton,” a video posted by Marina Helena, a Novo candidate for federal deputy. The preliminary ruling gave Instagram, X, Facebook and TikTok 24 hours to comply, with a daily fine of 1,000 reais for noncompliance, initially capped at 30,000 reais.
The video, which had passed 185,000 Instagram views, criticized Hilton’s positions on the six-days-on, one-day-off work schedule and the participation of transgender athletes in women’s competitions. It also referred to lawsuits she has brought against critics, calling her the “queen of lawsuits, owner of reason.”
Helena cast the decision as a threat to open political debate. “As always, Erika Hilton tries to censor those who disagree with her,” she said, arguing that Hilton presents herself as a defender of diversity while taking an authoritarian stance.
Hilton, a PSOL federal deputy, offered a sharply different account. She said the material was false and “gravely decontextualized,” alleged that it used deepfake technology and described it as political gender-based violence. She also sought a higher fine and referral to electoral prosecutors for a possible criminal inquiry, requests the preliminary ruling did not decide.
Judge Claudia Fonseca Fanucchi said electoral free speech protects “strong criticism, satire [and] irony,” and that merely harsh or unpleasant campaign messaging does not warrant judicial intervention. But she concluded that this video repeatedly invoked Hilton’s identity as a transgender woman in order to ridicule and disqualify her before voters, bringing it within electoral rules against discriminatory propaganda.
The order is temporary rather than a final ruling on the merits. Helena has two days to respond before the case proceeds to the Regional Electoral Prosecutor’s Office for an opinion.
