Dallagnol’s Senate bid is blocked as he vows to fight on
A single-justice ruling by Superior Electoral Court (TSE) Minister Floriano de Azevedo Marques rejected Deltan Dallagnol’s candidacy for the Senate in Paraná and ordered ballots cast for him to be counted as null. The decision reversed the Paraná regional electoral court, which had previously allowed the former prosecutor to run.
The court’s reasoning rests on the TSE’s 2023 finding that Dallagnol left the Federal Public Ministry while facing administrative proceedings that could have led to sanctions. Under Brazil’s Clean Record Law, members of the public ministry who resign under such circumstances can face eight years of ineligibility. Floriano said later developments, including the closure of proceedings at the National Council of the Public Ministry, did not alter the circumstances at the time of Dallagnol’s resignation. He wrote that the 2023 framework remained intact and described the resignation as one deemed fraudulent.
That interpretation differed from both the regional court and the Electoral Prosecutor General’s Office. The prosecutor’s office had favored keeping Dallagnol’s registration, while the TRE-PR had concluded that material examined in 2026 allowed a different result from the earlier TSE case. Floriano argued that a regional court could not depart from the superior court’s reading of the same facts without a substantial change in the case.
Dallagnol’s campaign, by contrast, says the single-justice ruling came too close to the vote and should be reviewed by the full court. In a video, he urged supporters not to give up, saying: “My name is on the ballot.” His lawyers said they were pursuing available legal measures and expected the decision to be reversed.
The disagreement is therefore not over whether the case will continue, but over the significance of the earlier resignation: the TSE minister sees it as the controlling basis for ineligibility, while Dallagnol’s side says the ruling improperly overrides both the regional court and voters’ choice.
