Dallagnol stays on Paraná ballot as TSE faces final eligibility ruling
TSE President Kassio Nunes Marques suspended the ruling that had blocked Deltan Dallagnol’s Senate candidacy in Paraná, leaving him on the ballot with a registration classified as approved pending appeal. His votes can be counted provisionally, while the full Superior Electoral Court decides the underlying eligibility case.

The reversal came after Justice Floriano de Azevedo Marques had, the previous night, overturned a Paraná regional electoral ruling that allowed Dallagnol to run and ordered votes cast for him to be nullified. Nunes Marques stressed the practical problem: the decision arrived after voting machines had been prepared and Dallagnol’s name remained displayed. “There is no longer time to inform Paraná voters that votes cast for a candidate appearing on the ballot will be disregarded,” he wrote.

Accounts aligned with Dallagnol’s supporters put greater weight on procedure. They argue that Floriano’s individual ruling, issued shortly before voting, should not settle a matter they say belongs before the court as a whole. Nunes Marques similarly wrote that a justice’s power to decide alone is exceptional, while “collegiality is the ordinary form of expression of the Court.”

The opposing legal concern is not resolved by the suspension. Dallagnol’s critics contend that his 2021 resignation from the Federal Public Ministry, while he faced possible disciplinary proceedings, triggered Brazil’s Clean Record Law. The TSE unanimously removed him from his federal deputy seat in 2023 over related circumstances; the current case asks whether that ineligibility still applies.

Thus, the immediate order protects voters from having ballots discarded without warning, while leaving intact the challenge to Dallagnol’s eligibility. The plenary ruling will determine whether his candidacy and the votes he receives are ultimately valid.
