Garotinho Withdrawal Could Turn Rio Runoff Into First-Round Win

Anthony Garotinho’s bid to withdraw his electoral appeal could remove his votes from Rio’s tally and lift Douglas Ruas above 50%. Eduardo Paes calls the move an effort to deny voters a runoff, while other accounts stress that the TSE still must decide.

Garotinho Withdrawal Could Turn Rio Runoff Into First-Round Win
Anthony Garotinho has asked Brazil’s Superior Electoral Court, or TSE, to withdraw his appeal against the rejection of his candidacy for governor of Rio de Janeiro. The request has put a possible first-round victory for Douglas Ruas at the center of a dispute that had appeared headed for a runoff.

The immediate legal question remains unresolved. TSE Justice Floriano de Azevedo Marques gave the Electoral Prosecutor General’s Office two days to weigh in before considering the request. Garotinho received 274,411 votes, or 3.17% of the first-round total, which were recorded as annulled sub judice while his appeal was pending.

Eduardo Paes, the PSD candidate who finished behind Ruas, argues that the withdrawal is more than a procedural development. He called it an “arrangement” aimed at electing Ruas and said it would shift voters’ power to decide the governorship in a second round to Garotinho’s legal decision. Paes has urged that the runoff proceed.

Accounts sympathetic to Ruas emphasize a different sequence: Garotinho’s registration had been rejected, and his lawyers described the withdrawal as “free, express, conscious and irreversible.” Under that reading, if the withdrawal is accepted and Garotinho’s votes are definitively excluded, Ruas’ share would rise from 49.27% to about 50.88%, while Paes’ would reach roughly 44.16%.

The two sides therefore differ over the political meaning of the move, but not over its potential effect. Ruas is not automatically declared governor: the TSE must formalize the withdrawal and retotalize the vote. A post shared by Rodrigo Constantino celebrated that prospect, saying Ruas “should be declared governor elected” in the first round if Garotinho’s votes remain outside the valid-vote calculation.
