Ricardo Villas Bôas Cueva, the electoral corregidor at Brazil’s Superior Electoral Court (TSE), suspended an earlier order that had taken the “Exército do Lula” WhatsApp channel offline and restored its operation while the full court considers the case. The channel, created by federal lawmaker André Janones, had roughly 3.3 million followers.

The original order by TSE president Kassio Nunes Marques treated the channel as a vehicle for large-scale dissemination of content the court had previously found unsupported. He argued that removing individual posts would not adequately protect voters because messages could rapidly reach millions of devices and be copied beyond platform controls.

Janones and Lula’s campaign cast the suspension differently: as censorship and undue judicial intervention in an electoral contest. Digital-rights specialists quoted by Agência Brasil said the closure went beyond combating misinformation, contending that allegedly unlawful material should be removed post by post rather than by shutting an entire forum for political organization. Bruna Santos of Witness called the measure “disproportionate,” while technology specialist Henrique Sampaio warned that the label of false news should not become a general justification for suppressing legitimate political organizing.

Cueva’s ruling did not settle the underlying allegation. Instead, it questioned whether the evidentiary basis justified a complete shutdown. He said a full-channel suspension requires proof of the conduct’s scope and repetition, its connection to the affected channel, and the inadequacy of narrower measures aimed at specific posts.

Flávio Bolsonaro’s legal team maintains that the restriction was necessary. It described the channel as a command center for coordinated false content and called Cueva’s restoration “complacency” toward its dissemination. Yet Cueva imposed conditions on the channel’s administrators, barring them from republishing material already ruled unlawful by the TSE and leaving open the prospect of another suspension if violations recur.
