Open for Comment: Improving Wage Protections for the Temporary and Permanent Employment of Certain Foreign Nationals in the United States

Labor Department — The Department of Labor (DOL or the Department) is issuing this Notice of Proposed Rulemaking (NPRM) to solicit comments and public input regarding its proposal to revise Employment and Training Administration (ETA) regulations governing the prevailing wages for employment opportunities that United States (U.S.) employers seek to fill with alien workers on a permanent or temporary basis through certain EB-2 and EB-3 employment-based immigrant visas via the Permanent Labor Certification (PERM) program or through H-1B, H-1B1, or E-3 nonimmigrant visas. Specifically, DOL is proposing to amend its regulations governing the PERM program and Labor Condition Applications (LCAs) to incorporate changes to the computation of wage levels under the Department's four-tiered prevailing wage structure based on the Occupational Employment and Wage Statistics (OEWS) wage survey administered by the Department's Bureau of Labor Statistics (BLS). These proposed revisions aim to better align prevailing wage levels with the wages paid to U.S. workers who are similarly employed in the occupation and area of intended employment. The Department's proposed revisions also seek to strengthen program integrity by reducing the incentive for employers to use these programs to replace, rather than supplement, U.S. workers by employing lower-paid alien workers. In addition, the revision would enable the Department to more effectively ensure that the employment of immigrant and nonimmigrant workers admitted or otherwise provided one of the covered statuses does not adversely affect the wages and working conditions of U.S. workers. Open for Comment: Update to EPAAR Text of Provisions and Clauses, Signing of Uniform Hazardous Wastes Manifests

Environmental Protection Agency — The Environmental Protection Agency (EPA) is proposing a new EPAAR, Provision and Clause in Solicitation Provisions and Contract Clauses, and Environmental, Conservation, Occupational Safety, and Drug-Free Workplace. The EPA currently has a local clause, which involves the signing of Uniform Hazardous Waste Manifests for Superfund sites. The new clause will enable contractors to sign the Waste Manifest at EPA worksites for the removal of hazardous and non- hazardous materials at both Superfund and non-Superfund sites. The addition of the new clause will allow work to continue when EPA personnel are not present at the worksite. (61 days remaining)

Open for Comment: Elimination of Time-in-Grade

Personnel Management Office — The Office of Personnel Management (OPM) proposes eliminating the Time-in-Grade (TIG) restriction on advancement to competitive service positions in the General Schedule. Currently, employees in competitive service General Schedule positions in grades 5 and above must serve 52 weeks in grade before becoming eligible for promotion to the next grade level. Abolishing the restriction would eliminate the 52-week service requirement. If the requirement is eliminated, an employee must continue to meet occupational qualification standard requirements, and any additional job-related qualification requirements. (60 days remaining)

Open for Comment: Clarifying Special (Occupational) Tax Payments Per Business Activity

Justice Department — The Bureau of Alcohol, Tobacco, Firearms, and Explosives ("ATF") proposes amending Department of Justice ("Department") regulations to clarify that a person engaged in the business of dealing, importing, or manufacturing firearms regulated under the National Firearms Act must pay a special (occupational) tax ("SOT") for each business activity conducted at the same location. However, they are not required to pay a tax for each license they have at that location if the licenses are for the same type of business activity. The rule proposes clarifying that licensees pay one SOT per business activity (manufacturing, importing, or dealing). (61 days remaining)
